The use of this website as well as relationships between CoolArts, Maihofstrasse 63, 6006 Luzern and its customers the following terms and conditions (GTC) apply in the use of the website or for ordering goods in the current version. The offer on this web site is directed only to customers residing in Switzerland.
These terms apply exclusively. Contrary, complementary or other terms and conditions subject to their validity express written confirmation by CoolArts. The customer agrees to the use of this website or in an order for goods to recognize these Conditions, including delivery and payment comprehensively.
If any provision of these terms and conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions remain.

All offers on this website are considered subject to change and should not be construed as a binding offer.
CoolArts can not guarantee that the products listed are available at the time of ordering. Therefore, all information on availability and delivery times are without engagement and are subject to change at any time without notice.
The prices of Cool Arts include, unless otherwise stated, VAT, any advanced recycling fee (VRG) and copyright levies on electronic equipment. All prices are net in Swiss francs (CHF). Any shipping costs are, unless otherwise provided additionally charged and have to be paid by the customer. Shipping costs are shown separately in the order process. Subject to technical changes, errors and omissions excepted, in particular, CoolArts price changes made at any time without notice. In the selling prices any consulting, advisory and support services are included.
The offers on this website are non-binding request to the customer to order at CoolArts products and / or services. By placing an order on this website, including the adoption of these Conditions, the customer makes a legally binding offer to contract. CoolArts then transmits an automatic "Order Confirmation" via e-mail that confirms that the customer's offer has been received by CoolArts. Actual orders are binding for the client. Unless otherwise stated, there is no return or withdrawal.
The contract is concluded when an acceptance by CoolArts is sent via email, in which the shipment of products or services ordered is confirmed.
Orders are only delivered after full payment is received (except for delivery against bill), and provided that the goods are available. If, after conclusion of the contract that the ordered goods can not be delivered in full or not, CoolArts is entitled to withdraw from the contract or part of a contract. If payment of the customer already is received at Cool Arts, the payment to the customer will be refunded. If payment is not made, the customer will be exempt from the obligation to pay. CoolArts isn’t committed in the event of a cancellation, to deliver a replacement.
Payment and retention of title
Customers can choose from the payment options listed in the order process available. CoolArts reserves the right to exclude customers without giving reasons by different payment options or to insist on payment in advance. CoolArts, in case of delay of payment can charge interest rate of 5% per year and a maximum fine of CHF 20.- per reminder. The products delivered to the customer until full payment is owned by CoolArts.
Delivery, audit, complaints and returns
The deliveries are sent by post or courier to the address specified by the customer in the order. The invoice will be issued by email or by post. By sending benefit and risk pass to the customer, to the extent permitted by law.
If delivery is refused or undeliverable, CoolArts may terminate the contract after a complaint message by email to the customers and setting a reasonable period and make the cost of activities into account.
The customer is obliged to check the delivered goods immediately after receipt of delivery and to identify any deficiencies for CoolArts warrants immediately in writing by letter or email to the address specified.
Returns to CoolArts effected for the account and risk of the customer. The customer has to return the goods in their original packaging, complete with all accessories and sent together with the delivery note and a detailed description of the defects to the specified CoolArts return address in the imprint.
If the result of the examination by CoolArts shows that the goods have no observable defects or they do not fall under the manufacturer's warranty, CoolArts can charge the intrigues, the return or the possible disposal, to the customer.
Right of withdrawal
The exercise of the right leads to a reversal of the contract. The customer has to return the goods within 10 calendar days in original packaging, complete with all accessories and return it together with the delivery form to the specified CoolArts return address in the imprint. Returns to CoolArts effected for the account and risk of the customer. A payment already made will be refunded within 20 days to the customer, provided Cool Arts has already received the returned goods or the customer can provide proof of postage.
CoolArts reserves the right to charge for damage, excessive wear or loss of value due to inappropriate handling, an adequate compensation and deduct the reduced value of the purchase price already paid or to charge the customer.
In the following cases no right of withdrawal shall be granted:
(i) If the contract has an element of chance, especially because the price is subject to fluctuations outside the supplier's control.
(ii) If the contract has a movable thing of the sort that is not suitable due to their condition for a return or can spoil quickly;
(iii) If the contract has a movable thing of the sort that is made according to the specifications of the consumer or clearly tailored to personal needs;
(iv) If the contract has as its object the digital content and this content is not set to a fixed volume available or if the contract by both parties is to be fulfilled immediately complete;
(v) If the contract has a service to the object and the contract is completely fulfilled by the provider with the prior specific consent of the consumer before the withdrawal period has expired.
(vi) If a contract has multiple services, above paragraph (v) applies for each of these sub-services.
CoolArts strives to deliver goods in perfect quality. In a timely notice of defects CoolArts takes over during the statutory warranty period of usually two years from the date of purchase warranty for defects and functionality purchased by the client. It is at the discretion of CoolArts to provide free repairs, replacement of equal or refund the purchase price. Other claims are excluded.
From the warranties are the normal wear and tear as well as the consequences of improper treatment or damage caused by the customer or third parties as well as defects that are due to circumstances not covered. Likewise, the warranty for consumption and wear and tear is excluded.

In case of dispute, exclusively Swiss substantive law apply to the exclusion of conflicts of law provisions. The UN Sales Convention (CISG) is explicitly excluded.
The jurisdiction is Lucerne, unless the law provides no compelling jurisdiction.
Type of data collected
